Objectives

The purpose of this seminar is to introduce the basic principles of construction law, not to provide a detailed consideration of particular standard form contracts or contractual arrangements, or to give a detailed analysis of recent construction law cases.

This course considers the legal framework within which building, and engineering projects are designed and constructed including relevant aspects of the law of contract and tort. It explores the characteristics of the various types of dispute that arise on such projects and the methods available for their resolution and discusses the principles which underlie the various standard form contracts commonly used in the construction industry.

This course is for anyone new to this area of law.

  • Participants in the construction industry: roles and responsibilities.
  • Plans of Work and their significance
  • Legal relationships – procurement, payment and third-party rights
  • Contract issues: letters of intent, implied terms, assignment, sub-contracting, certificates
  • Tort issues – the duty of care problem
  • Disputes and their resolution – payment, time and money, defects limitation issues
